Draft. This page is a working draft for legal review before launch. Items in highlighted brackets are waiting on company details.
This policy explains how Brandgentic LLC ("Brandgentic", "we", "us") handles personal information collected through brandgentic.co and related pages (the "Site"). Brandgentic is a Delaware limited liability company. [Business address, once the company is registered]
What we collect
Information you give us
- Partner applications: name, work email, company, and optionally your title, phone number, brand website, product category, revenue range, target markets, the types of intellectual property your brand holds and your description of it, and the partnership structure you're interested in. Please don't send confidential details, such as unpublished patent applications or trade secrets, through the form.
- Investor access requests: how you're investing, your state or territory of residence and confirmation that you're in the United States, the accredited-investor category you select, your acknowledgments, name, email, and optionally phone, expected investment range and how you heard about us. We do not ask for income or net-worth figures, tax documents or identification on the Site.
- Text message consent: if you tick the box to receive texts, we record that you agreed, the wording you agreed to and when.
- Emails you send us.
Information collected automatically
- Form context: the page you submitted from, the referring page, campaign tags in the link you arrived on (such as utm parameters), and the country your request came from as reported by our hosting provider, and, if you allowed advertising cookies, the advertising and analytics identifiers set by Google and Meta (such as a click id or browser id). We do not store your IP address with your submission. Our investor pages are shown only to visitors in the United States, based on the country our hosting provider reports.
- Bot protection: Cloudflare Turnstile checks that form submissions come from people. It processes technical signals from your browser for that purpose.
- Analytics and advertising (with consent where required): if enabled, Google Analytics 4 and the Meta Pixel, loaded through Google Tag Manager, collect information about your visit such as pages viewed, device and browser type, and interactions. See our cookie policy. On our investor pages they record visits and that a request was made, never your accredited-investor category or investment amount.
How we use it
- To review applications and investor requests, and to follow up about them by email, phone, and, if you agreed, text message (SMS or iMessage).
- To keep records of investor requests and acknowledgments, as securities rules require.
- To protect the Site from spam and abuse.
- To understand how the Site is used and to measure our advertising, where you have allowed it.
When you submit a form and have allowed advertising cookies, we may send Meta, and later Google, a record that a lead occurred and how it progressed (for example, that a call took place), with your email and phone number hashed (scrambled) so they can't be read, to measure our ads. These records never include your accredited-investor category, investment amount or other form answers.
Text messages
We send texts only if you opt in. Message frequency varies, and message and data rates may apply. Reply STOP to opt out at any time, or HELP for help. Your consent to texts is not a condition of applying or investing, and we don't share your phone number or text consent with third parties for their marketing.
Who we share it with
We don't sell personal information. We share it only with service providers that help us run the Site and our business, including Cloudflare (hosting, database and bot protection), Google (analytics and tag management), Meta (advertising measurement), the customer relationship management system our team uses to follow up, and our email and text-messaging providers, with our affiliated operating companies where needed to evaluate a partnership, with professional advisers such as lawyers and accountants, and where the law requires it. [Name the email, text-messaging and investor-verification providers once chosen.]
How long we keep it
We keep applications and investor requests for as long as needed to respond and maintain the relationship, and investor records for as long as securities and tax rules require. [Confirm retention periods.]
Your choices and rights
- You can change your cookie choices at any time using "Cookie settings" in the footer.
- You can ask us to access, correct or delete your personal information by emailing [email protected]. Depending on where you live, including California and the EU or UK, you may have additional rights, such as to object to certain processing or to complain to a data protection authority.
International transfers
We are based in the United States and our providers may process information in other countries. Where the law requires it, we rely on appropriate safeguards for these transfers.
Children
The Site is for businesses and investors and is not directed to children under 16.
Changes
We'll post any changes on this page and update the date above.
